Thank you for taking interest in the Services of PHZ Game Studios Oy (“PHZ Game Studios” or “We”). These Terms of Service (“Terms”) apply to the use of all services provided by PHZ Game Studios, including games developed and/or published by PHZ Game Studios (“Game”), PHZ Game Studios webpages, forums and other services, such as applications or any social functions in the games or services or any other services PHZ Game Studios has attached these Terms to (“Services”). These Terms govern the relationship between you (“You” or “User”) and PHZ Game Studios regarding the use of the Services. By downloading, installing, accessing or using any part of the Services You agree to these Terms and accept to be bound by them. These Terms affect your legal rights and obligations, so if You do not agree to the Terms, You may not use Our Services. You agree that you are at least 13 years old and that if you are between 13 years and 18 years old, your legal guardian has reviewed and agreed to these Terms and is accepting of your accessing and using our Services.
Names and Discussions Guidelines
Any names or messages you put into the Game or the Services should follow these guidelines. Failure to comply may result in deletion of messages, forced name changes or even deletion of game accounts.
You agree your written word, including use of emojis, whether explicitly or implied, will NOT:
- Infringe any copyrights
- Use derogatory terms or slurs
- Incite to ethnic, racial or other hatred
- Be used for bullying or harassment of any kind
- Contain anything sexually suggestive neither explicit language nor an innuendo
- Contain any grossly graphically violent language or otherwise offensive or threatening imagery
Cheating and Bug Abuse
You agree to not use intentionally any means whatsoever to gain an unfair advantage including but not limited to repeatedly applying unintended software behavior (“bugs”), reverse engineering, use of external cheat tools, game client manipulation. If you have discovered a way to do so you agree to inform PHZ Game Studios privately about it in a timely manner.
Indemnification
You agree to indemnify and hold harmless PHZ Game Studios Oy and its parent, subsidiaries, and affiliates, and their owners, directors, officers, managers, employees, shareholders, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of the Terms, including the Names and Discussions Guidelines, or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this Section. In such event, you shall provide us with such cooperation as is reasonably requested by us.
Limits
PHZ Game Studios reserves the right to limit your use of the Services, including your access to parts or all of it. PHZ Game Studios reserves the right to restrict, suspend or terminate your account if we believe you may be in breach of this Contract or law or are misusing the Services (e.g. violating Names and Discussions Guidelines). Furthermore PHZ Game Studios as the sole owner of all game data and configurations reserves the right to wipe, transfer, add, subtract, modify, delete or do whatever with any game values, resources, unlocks, in app purchase products and everything related to the game including but not limited to the castles themselves. As the sole owner of the game configurations PHZ Game Studios has a perpetual right to use them for any legal application including but not limited to marketing and developing the Game. Any real money purchases including but not limited to in app purchases of virtual currency or other virtual content (further just “Content”) are limited to Users who are either 18 years of age or older, or under the age of 18 and have the consent of a legal guardian to make the purchase. Purchase of Content grants you a limited, nontransferable, non-sublicensable, revocable license to use such Content in conjunction with your use of the Services. You acknowledge that you do not acquire any ownership rights in or to the Content. You agree that the Content do not constitute actual currency or property of any type. Content can not be re-sold, transferred or exchanged for “real money”, “real” goods or “real” services from us or anyone else. You also agree that you will only obtain Game Content from us and through means provided by us, and not from any third-party platform, exchange, broker, or other mechanism, unless expressly authorized. Pricing and availability of Content are subject to change without notice. We reserve the right at any time to change and update our pricing and inventory of Content and the specifications of said Content. All Content is provided “as is,” without any warranty. You agree that all sales by us to you of Content are final and that we will not permit exchanges or refunds for any unused Content once the transaction has been made. We may cancel, suspend, or terminate your Account and your access to any Content or the Services in our sole discretion and without prior notice including but not limited to failure of compliance with the Terms or suspect of any fraud, misuse or unlawful activity associated with your account. We have no obligation or responsibility to, and will not reimburse or refund your for any Content lost due to such cancellation, suspension, or termination. You acknowledge that PHZ Game Studios is not required to provide a refund for any reason, and that you will not receive money or other compensation for unused Content when your account is closed, whether such closure was voluntary or involuntary. We have the right to offer, modify, eliminate, and/or terminate Content and/or Services, or any portion thereof, at any time, without notice or liability to you.
Copyright and Trademark Information
All data, features, information, text, graphics images, music, sounds, photographs, illustrations, logos, messages, audio, information, video and other information or content that is available on the Site or in the Game, including Game configurations, are owned by PHZ Game Studios with all rights reserved, unless specified otherwise in credits or on the Site, or in same cases may be licensed to PHZ Game Studios by third parties (collectively, “PHZ Game Studios Content”).
PHZ Game Studios Content is protected by the intellectual property rights of PHZ Game Studios Oy or those owners. All content which qualifies for protection under Copyright Law under the laws of Finland, whether registered or unregistered. All trademarks displayed on the Site or in the Game are the trademarks of their respective owners, and constitute neither an endorsement nor a recommendation of such parties. In addition, such use of trademarks or links to the websites of third parties is not intended to imply, directly or indirectly, that those third parties endorse or have any affiliation with PHZ Game Studios.
Content creators and brand licensing
You may capture and use gameplay video footage or still images from PHZ Game Studios’ Games to create content such as “Let’s Play” videos, reviews, comments, blog posts, compilation videos, strategy tips, and similar (“Fan content”), provided that the reference to the original works is kept clear and intact, and that you follow the spirit of the Names and Discussions Guidelines in regards to our Games even outside of our Services, and do not use our Games for malicious purposes or claim ownership of the Game itself or take apart any assets from the Games to use in any other way that may obfuscate it from the source. You may use such Fan content for commercial gain and host, display and share it on any platform that abides by the laws and regulations of the European Union, provided that you do follow the rules and regulations of those platforms as well as this clause and do so in good faith.
